Pregnancy and motherhood are supposed to be wonderful and exciting for women. And toward that goal, the law requires employers to make accommodations for pregnant women who require time off from work for maternity leave or bed rest for a high risk pregnancy. Employers must also hold open the jobs of new mothers who take time off for maternity leave or to care for their newborn. Employers are also required to provide women with ample breaks and a private place if they wish to express (pump) breast milk. Despite these laws, some employers continue to discriminate against women based on being pregnant, their need for pregnancy-related leave, or their desire to express milk upon their return to work. This type of discrimination can take many forms, including being laid off, demoted, given a heavier workload, terminated for fabricated reasons, or not given ample breaks or a private place to express breast milk or see their doctor.
However, if you suffered discrimination once your employer learned that you were pregnant, or for taking time off to have your baby or to be on bed rest for a high risk pregnancy, or for wanting to express (pump) breast milk upon your return to work, you may have one or more viable claims against your employer.
